We all know the two big reasons that would cause Dems to lose the house majority this fall - Economy and Immigration. We also know where Dems stand on immigration - Amnesty and CIR. CIR is not popular among american voters and Republicans will play to that tune when they get the majority. They will spend all the time talking about securing the border and until the border is secure CIR wont be taken up for discussion. That means no CIR for the next few years (atleast until 2012). What is your PD? There is a portion of the memorandum that needs your child's age at the later of the date when PD is current or when petition is approved if PD is current by petition approval date.
I think you should submit an I-485 for your child as soon as possible or if the child is not in the US then file a I-824 immediately. This will serve as proof that your child "sought LPR status" within one year of your PD becoming current. Even if the 485 or 824 is rejected, you have established the fact that your child "sought LPR status" and leave room for administrative appeal in future.
This is just my 2 cents and I am not a lawyer. However, whichever way you interprete the new memorandum your child's CSPA age is under 21.

These are great points. They have helped me compile a list of issues and possible solutions.
Someone sent me a PM with a personal story that I thought exemplified some of the frustrations faced by skilled immigrants. I am going to include that story with my handout. If you have a strong story to tell about the broken system, feel free to PM me. You do not need to include any identifying information, but the story should be impactful. Remember this session is all about educating people who have influence.
One last point. One person mentioned about the proposal to offer green cards to immigrants who buy houses. This is a non-issue because if the backlog of greencards was cleared, many of those people would buy houses. I am sure many GC aspirants will not buy houses because they are uncertain if they will be here long enough to benefit.

In the long run it will. The issue was that people could not afford to pay their healthcare insurance premiums. Those of us who are lucky to have high paying jobs and good employers can very look down on the folks that don't have healthcare. However, health care is now a human right declared by United Nations in Dec 1948. In the US, the largest developed nation, there are millions who cannot get healthcare (only emergency care). Even if this healthcare doesn't reduce it drastically in the short term, it will stem the rising costs eventually. That is the long term projection at least. Think about how much cheaper prescription drugs are in Canada when compared to the US.
I think that "what we are debating here is "what is better for the US". You and I can contribute to the SS and Medicare system that we are not allowed to draw from until we have greencards or become naturalized citizens. The illegals you mention are in the same boat. The point that I am making is that the anti-immigration lobby sees all immigrants in a single light. If we try to divide ourselves away from the low-skilled we are not going to get anywhere. Immigration in general touches a number issues - civil and human rights, economics, etc.. By trying to distance ourselves from any of these issues, we are in fact make it more difficult for ourselves. For the record, I do want a green card, I want a fair system. I don't believe in treating one person different from another because of their background or the kind of work they perform. (that's just to give some perspective regarding my views on the issue). Hello!
My wife currently has a H4 stamped in her passport. She is India right now and is planning to travel in June 2007.
Now her H1 will most likely be approved. Does this mean she has to go for stamping her H1 VISA or can she travel on her H4 (valid till 2009)? Is it required to carry the approved I-797 for her H1?

Thank you for your effort. Recapture of unused visas will eliminate most of the backlogs (does it require a congressional approval or if anything can be done as a part of an admin fix). Anything that requires a congressional will be lumped with the CIR, we are a small group of people held hostage at the mercy of CIR.

Same here, Iam Dec 2005 and still waiting ..........
I have been looking at number and the IV forum and there are very handful number of cases with December 2005 that have been touched.
I think we need to cheer up and be optimistic in addition to creating SR, senator route and infopass. I have a feeling that all the October, Nov and December cases might be in a single lump of files and we will get it in the next week or so.

Anyway just by checking most of this consulting firms businesses they will be able to uncover all the fraud.
It's very unethical to make you lie on your resume and then try to market you to an employer with fake experience, also nobody has responded to my comment. Real Companies like PWC, IBM pay you while you're on bench, while this indian consulting companies break the law by not doing that.

Could you please post how this has affected your tax return filings, do we need to do something extra while filing tax returns if one is a pattern day trader?
Also it suggest that there should be minimum equity balance of 25K, are they referring to the value of stocks...
Yes as you said i too was thinking about it, there is only so much one can earn because in my situation i cannot shift employer, nor does the current one pay me enough or is willing too, so we all must look at alternate sources of income (but take our own risk and decision)....
I started trading with sharebuilder recently.... and they did give me a 50$ coupon to start with...

I found a unique way to cope with the stress of our immigration nightmare.
I always feared that this long wait to get the status issue settled would kill the entrepreneurial spirit that I have. The burning desire to do my own thing.
I have been trading stocks for the past 4 years or so now but just recently got interested in PDT - Pattern Day Trading (http://en.wikipedia.org/wiki/Pattern_day_trader) (Clickable)
I have found it very interesting as well as rewarding in terms of fulfilling the urge to do something more than what I am doing right now.
It is not easy and it is not for the weak hearted but the rewards are wholesome and tremendous.
I would like people who are interested to "PM" me or post replies here so we can exchange ideas
IMP NOTE: Trading stocks is a type of investment so It is perfectly legal to do so. You do not even require an EAD to do so .
No doubt that if you do have EAD you can trade as business entity as well.
Last but not the least
Do not forget to to keep the momentum up at IV and do donate to IV as often as you can .

Join state chapter, attend a meeting law maker training session, and then try to arrange appointments with aids, and go and meet with them. Then follow up with them. I think that the training part is important.

if someone with a PD of before July 2007 that is with EAD, ports to EB 2, will they lose their EAD card/status??
